Terms of Service
Welcome to Hexlands. These Terms of Service ("Terms") govern your use of the Hexlands mobile application and the hexlandsgame.com website (together, the "Service"). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 9 years old (or the minimum age required in your country) to use the Service. If you are under 13 in the United States (or under the equivalent age of digital consent in your country), you may use the Service only with the involvement and consent of a parent or legal guardian, and that parent or guardian agrees to these Terms on your behalf. To support younger players, chat in public multiplayer games is limited to a fixed set of preset phrases; open text and voice chat are available only in private games you create or join with people you know.
2. License
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Service on devices you own or control, solely for your personal, non-commercial entertainment, including the right to capture screenshots and replay videos of your own gameplay and share them with others for personal, non-commercial purposes, provided that any Hexlands branding or watermarks we include remain intact.
3. Account & Gameplay
Some features of the Service (such as multiplayer matches) may require you to create or use an account, join game sessions, or share a nickname with other players. You are responsible for the activity that occurs under your account and for keeping any credentials secure.
4. User Conduct
When using the Service, you agree not to:
- Violate any applicable law or regulation;
- Harass, threaten, or harm other players, including via in-game chat, voice, or nicknames;
- Cheat, exploit bugs, reverse-engineer, tamper with game state, or otherwise gain unfair advantage;
- Attempt to gain unauthorized access to the Service, our servers, or other users' accounts;
- Use the Service to transmit viruses, malware, spam, or other harmful content;
- Impersonate others or misrepresent your affiliation with any person or entity;
- Remove, alter, or obscure any Hexlands branding, watermarks, or attribution from any screenshots or replay videos you share;
- Use shared screenshots or replay videos of the Service for commercial purposes without our written permission.
5. User-Submitted Content & AI Training Data
The Service may allow you to submit content, such as bug reports, support requests, nicknames, or voice clips. You retain ownership of what you submit, but you grant us a worldwide, royalty-free license to use, store, reproduce, and process that content for the purpose of operating, improving, and supporting the Service. Do not submit anything you do not have the right to share, or that is unlawful, offensive, or infringing.
Single-player AI training data. When you play a single-player game against the AI and win, the Service automatically transmits an anonymised summary of that game (tile placements, meeple placements, move sequences, and scores) to our servers. By using the Service you grant us a worldwide, royalty-free, perpetual license to use this gameplay data to train and improve the Hexlands AI. This data is associated only with your device-generated random identifier and contains no personally identifiable information. You may opt out at any time via Settings → Privacy → AI Training in the app; opting out does not affect any other aspect of gameplay.
Content shared by other players. When you play the Service with others, your chosen nickname and in-game actions may appear in screenshots or replay videos that those other players generate and share outside the Service. You acknowledge this possibility when joining a multiplayer session.
6. Purchases, Subscriptions & In-App Items
Hexlands is free to download, and you can join any game at no cost. Creating your own games requires an active Hexlands Creator subscription.
6.1 Hexlands Creator subscription
- Price: US $1.99 per month (or the local-currency equivalent set by Apple for your App Store region), after an introductory 1-week free trial for eligible new subscribers.
- Billing: payment is charged to your Apple ID at confirmation of purchase. The subscription automatically renews every month unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
- Managing and cancelling: you can manage your subscription and turn off auto-renewal at any time in Settings → Apple ID → Subscriptions on your device. Cancelling stops future renewals; you retain access until the end of the current paid period. Deleting the app does not cancel the subscription.
- Free trial: if you choose not to continue, you must cancel at least 24 hours before the trial ends, or your Apple ID will be charged for the first paid period at the then-current price. Free trials are available only to eligible new subscribers as determined by Apple.
- Family Sharing: this subscription supports Apple Family Sharing and may be shared with up to five additional family members in your Family group, subject to Apple's Family Sharing rules.
- Refunds: all payments are processed by Apple. Refund requests are handled by Apple in accordance with the App Store's refund policies; we are generally unable to issue refunds directly.
6.2 In-app items generally
All in-app purchases are processed by Apple and are subject to the App Store's own terms. In-app items and subscription entitlements are licensed, not sold, have no cash value, and are non-transferable. We may change subscription pricing, features, or availability from time to time; changes to recurring charges will be disclosed as required by Apple and applicable law, and your continued use of the Service after a change takes effect constitutes acceptance of the new pricing.
7. Updates & Availability
We may update, modify, or discontinue any part of the Service at any time. We do not guarantee that the Service will be available at all times, be error-free, or remain backwards-compatible with older versions.
8. Intellectual Property
The Service, including its artwork, graphics, logos, code, audio, and game design, is owned by Hexlands or its licensors and is protected by copyright, trademark, and other laws. Except for the limited license granted above, no rights are transferred to you.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your expectations or be uninterrupted or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, Hexlands and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $10. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you to the extent prohibited by applicable law (including, for EU/UK consumers, statutory rights that cannot be excluded by contract).
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including if we believe you have violated these Terms. You may stop using the Service at any time by uninstalling the app.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction there.
14. Dispute Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us via the Support page and providing a brief description of the issue and your contact information. We will try to resolve the dispute informally within 30 days. If we cannot resolve it in that time, either party may pursue the dispute in the courts identified in Section 13, subject to any statutory rights you have that cannot be waived by contract.
15. Apple and the App Store
The following terms apply to your use of the Hexlands iOS application obtained through the Apple App Store:
- These Terms are an agreement between you and Hexlands only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
- The license granted in Section 2 is limited to use of the Service on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Service.
- In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.
- Apple is not responsible for addressing any claims by you or any third party relating to the Service or your possession and use of it, including (a) product-liability claims, (b) any claim that the Service fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer-protection, privacy, or similar legislation.
- In the event of any third-party claim that the Service or your possession and use of it infringes that third party's intellectual property rights, Hexlands, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of the claim to the extent required by these Terms.
- You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must also comply with applicable third-party terms of agreement (for example, the App Store Terms of Service) when using the Service.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
